Copyright & DMCA Policy

Version 2026-10-05 · Last updated 2026-10-05 · Split Mix Holdings LLC

Draft, pending legal review. This is a complete working draft provided for transparency. It has not been reviewed by an attorney and is not final or legal advice. Items marked [ATTORNEY] or [OWNER] are placeholders that must be completed before launch, and the Designated Agent must be registered with the U.S. Copyright Office before this policy is relied upon for safe-harbor protection.

Split Mix Holdings LLC ("Split Mix," "we," "us") respects the intellectual property rights of others and expects users of SplitJam and our website to do the same. This policy explains how we handle copyright complaints under the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

1. SplitJam runs on your Mac

SplitJam is a desktop application that, in the current version, processes audio locally on your own computer. In normal operation it does not upload to us, and we do not receive or store, the audio you load or the stems, recordings, or exports you create. Because that material is processed on your device, there is generally nothing on our side for us to remove in response to a notice about your Content. This policy therefore applies principally to material we actually host (for example, content on our website) and to our handling of repeat infringers.

2. Your responsibility as a user

You are responsible for ensuring you have the rights to any audio you use with SplitJam. Separating, recording, or exporting a work you do not own or are not authorized to use may infringe the rights of others. Using SplitJam to infringe copyright is a violation of our Terms of Service.

3. Filing a copyright infringement notice

If you believe material we host infringes your copyright, send a written notice to our Designated Agent (below) that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

  • a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works);
  • identification of the material claimed to be infringing, with enough detail and location information (such as a URL) for us to find it;
  • your name, mailing address, telephone number, and email address;
  • a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages.

4. Designated Agent

Send DMCA notices to our Designated Agent:

  • [OWNER] Agent name / role (e.g. "DMCA Agent, Split Mix Holdings LLC")
  • [OWNER] Mailing address of the LLC
  • Email: dmca@splitjam.music [OWNER] confirm this inbox is live

[ATTORNEY/OWNER] The Designated Agent must be registered with the U.S. Copyright Office's DMCA Designated Agent Directory (and the registration renewed as required) for safe-harbor protection under § 512 to apply. Complete this before relying on this policy.

5. Counter-notification

If your material was removed or disabled and you believe this was a mistake or misidentification, you may send a counter-notification to the Designated Agent that includes: your physical or electronic signature; identification of the material and its former location; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., any district in which we may be found) and will accept service of process from the complainant or its agent. Upon a valid counter-notification, we may restore the material as permitted by the DMCA unless the complainant files a court action.

6. Repeat-infringer policy

In appropriate circumstances and at our discretion, we will suspend or terminate the access, accounts, or licenses of users who are repeat infringers, consistent with 17 U.S.C. § 512(i). Because SplitJam is account-free, this applies to any services where we can identify the user (for example, a license activation associated with repeated, substantiated infringement) and to use of our website.

7. Changes to this policy

We may update this policy from time to time. The version and date above indicate when it was last revised.
